Terms of service

These Terms and Conditions govern the relationship between you and Thisgame.com, and apply to your use and access of the Online Store. By selecting the “Accept” button, or by accessing or using the Online Store, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and any other applicable legal agreements as a Thisgame.com Account holder, as updated periodically. If you do not agree with these Terms and Conditions, you must immediately cease using or accessing the Online Store. If you are using the Online Store on behalf of a third party, such as a business entity, you represent and warrant that you are authorized to bind that third party to these Terms and Conditions.

1. Definitions

The following terms have specific meanings throughout these Terms and Conditions:

a. “Account” refers to the account Users may create through the Online Store to access the Services.

b. “Add-On Keys” refers to digital Programs that provide additional functionality, special weapons, characters, virtual currency, or subscription-based access to content or services within a specific Program.

c. “Agreement” and “Terms and Conditions” collectively refer to all terms, conditions, and notices in this document (as amended periodically) and all other Thisgame.com rules, policies, and procedures available on the Online Store, including the Thisgame.com Privacy Policy.

d. “Buyer” refers to a person who contacts, engages, or intends to purchase a Program sold by a Seller through the Online Store.

e. “Game Key” refers to a serial number or code used to register and activate a specific Program, provided to you in the Confirmation Order upon successful payment of the Program Price.

f. “Thisgame.com’s Content” includes any content generated by or belonging to Thisgame.com, such as the name, trademark, logo, information about Thisgame.com and its employees, text, correspondence, photographs, graphics, applications, video/audio recordings, designs, features, and other materials.

g. “Thisgame.com”, “we”, or “us” collectively refer to This Game Ltd., a private company incorporated under the laws of Jersey, with its principal place of business at Office 115, Floor One, Liberation Station, Esplanade, St Helier JE2 3AS, Jersey.

h. “Confirmation Order” refers to written or electronic confirmations sent by Thisgame.com to Buyers regarding Programs, which may include the Game Key, Program Price, payment terms, Program details, publisher/developer information, and any special conditions.

i. “Content” refers to any content submitted, generated, or displayed through the Online Store, including Program details, text, correspondence, graphics, software, applications, video/audio recordings, company logos, photos, designs, features, User reviews, and other materials, including User Content.

j. “Online Store” refers to Thisgame.com’s platform, including its website (https://www.thisgame.com), subpages, subdomains, related domains, and any mobile application facilitating access to or provision of the Services.

k. “Privacy Policy” refers to Thisgame.com’s privacy practices for the Online Store, available at https://www.thisgame.com/privacy-policy.

l. “Program” refers to digital or virtual games, software (business or consumer), related digital products, Content, Add-On Keys, or services available through the Online Store, including software, documentation, ads, technology, data, and other digital materials provided through updates or versions of the Program.

m. “Program Price” refers to the total amount specified in the Confirmation Order for the purchase of a Program.

n. “Seller” refers to a person or company that engages or intends to sell a Program through the Online Store, which may include the Program’s publisher or developer.

o. “Seller Services” refers to services provided by Sellers related to a Program, including the provision of Programs and any technical or support services outlined in the Seller Agreement.

p. “Seller Agreement” refers to the terms and conditions or agreement between a Buyer and a Seller, such as an end-user license agreement specific to a Program.

q. “Service” refers to the online and/or offline services provided by Thisgame.com to facilitate access to Programs, Sellers, and Seller Services, including access to the online community, communication tools, and payment services.

r. “Third Party Content” refers to content originating from parties other than Thisgame.com, Sellers, or Buyers.

s. “User Content” refers to content created or submitted by Users through the Online Store, including text, correspondence, and photographs.

t. “User”, “you”, or “your” collectively refer to the person, company, or organization visiting or using the Online Store and/or Service, including visitors, Account holders, or Buyers.

2. About Thisgame.com and the Online Store

2.1 Thisgame.com is an online platform connecting Buyers with Sellers to facilitate the sale and purchase of Programs. The Online Store provides access to various Programs and supports transactions between Sellers and Buyers.

2.2 You acknowledge that Thisgame.com acts as an intermediary, and any offer or sale through the Online Store is between the Seller and Buyer. Thisgame.com facilitates transactions by maintaining the Online Store’s functionality and providing Services to enhance transaction safety, speed, and reliability.

2.3 Buyers acknowledge that any transaction or agreement with a Seller, whether oral or written, is solely between the Buyer and Seller. Thisgame.com is not a party to such agreements. Buyers may need to enter into Seller Agreements or accept Seller terms to purchase a Program, and Thisgame.com is not responsible for obligations under those agreements or liable for issues arising from them.

2.4 Thisgame.com does not own, sell, resell, furnish, provide, rent, or host any Program or Seller Services. Sellers are solely responsible for their Programs and Services.

2.5 Thisgame.com provides Services to Buyers free of charge but may charge Sellers a fee per Program after successful payment of the Program Price.

2.6 Thisgame.com does not endorse any Seller over another. While we verify Seller information and confirm licensing where possible, we do not guarantee Sellers’ licensing, ability, competence, or qualifications.

2.7 Although Sellers are required to provide accurate Program and identity details, Thisgame.com does not confirm these details. Buyers must independently research and evaluate Programs and Sellers.

2.8 Promotions, such as sales or giveaways, may be offered through the Online Store and can be modified or discontinued without notice.

2.9 The Online Store may not be available in all countries, and Thisgame.com may modify, suspend, or discontinue it at any time without notice.

3. Changes to the Terms and Conditions

3.1 Thisgame.com may amend this Agreement at its discretion. While we will endeavor to notify you of changes, prior notification is not required.

3.2 Amended Agreements will be published on the Online Store. Continued use of the Online Store or Services after publication constitutes acceptance of the revised terms.

3.3 You agree to review the Terms and Conditions each time you visit the Online Store or use Services. If you do not agree, you must stop using the Online Store and Services immediately.

4. Eligibility, Account Registration, and Security Checks

4.1 To use Services, you may need to create an Account using your name and email or existing Google/Facebook accounts, with a unique username and password.

4.2 You are responsible for Account security and all activities under it. Provide accurate, updated information, do not share your password, and notify Thisgame.com immediately of unauthorized use at support@thisgame.com. You are liable for all uses of your Account, and Thisgame.com may act on instructions received through it without liability for losses.

4.3 Your Account and its information (e.g., contact details, billing, Game Key details) are personal and may not be sold, transferred, or charged to others unless expressly permitted.

4.4 By creating an Account or using the Online Store, you consent to communications about Services via email, phone, or other provided contact methods. Opt out by contacting us through the Contact Us section.

4.5 Buyers must verify their phone number via our automated system to access purchased Programs. Information provided is subject to the Privacy Policy and used only for identity verification, not marketing. We may request additional identity verification (e.g., valid ID) and decline or refund suspected fraudulent orders. Using VPNs, proxies, or VoIP numbers may cause delays, ID checks, or order cancellations. Phone numbers may undergo geographic checks, with location data retained for 24 hours before deletion.

4.6 Thisgame.com may suspend or terminate Accounts if User Content or registration information is inaccurate, false, or misleading, or if usernames violate this Agreement.

5. User Conduct and Restrictions

5.1 Programs are distributed electronically, with no physical delivery. You receive a legitimate Game Key to activate the Program on platforms like Steam, Origin, or Uplay.

5.2 Thisgame.com’s system instantly allocates Game Keys upon payment and security clearance. Keys are available in your Account and emailed. Thisgame.com is not liable for lost, stolen, or unauthorized use of Game Keys.

5.3 Purchasing a Program grants a license to use it from the Seller or licensors, not ownership. You receive a limited, non-exclusive, non-transferable, personal license, with all other rights reserved by the Seller or licensors.

5.4 Some Programs have specific use restrictions, such as country limitations, Account-specific use, time limits, or device compatibility.

5.5 Users must not transmit Content that is unlawful, defamatory, harassing, political, pornographic, discriminatory, spammy, malicious, infringing, impersonating, or privacy-violating.

5.6 Programs, Content, and Services may only be used as permitted by this Agreement or Seller Agreements. You may not copy, reproduce, reverse engineer, or exploit Programs commercially without Seller consent.

5.7 Programs are for personal use only. You may not sell, rent, lease, or commercially exploit them without Seller consent.

5.8 Thisgame.com may terminate or deny access to Accounts or Services for inappropriate conduct, with or without notice.

6. Programs

6.1 Upon payment, you may download or access a Program for personal use. Ensure your device meets system requirements before purchase. Some Programs require a license key for activation.

6.2 Buyers are responsible for internet or connection charges related to downloading or accessing Programs.

6.3 Free trial or limited versions of Programs may have restricted features or time limits and can be withdrawn without notice.

6.4 Some Programs are downloaded locally, while others are hosted externally and accessed via Seller or third-party accounts. Such accounts are subject to Seller or third-party terms, not Thisgame.com’s.

6.5 Seller platforms are managed by Sellers or third parties, and Thisgame.com does not guarantee their availability or uptime.

6.6 Add-On Keys have specific restrictions, and some (e.g., virtual currency) are single-use. Subscriptions may auto-renew unless disabled, using a stored payment method.

6.7 After purchase, you are responsible for downloading and accessing the Program, including retrieving the license key, and bear all risks of loss thereafter. Contact support@thisgame.com for assistance.

6.8 Program ratings are provided by Sellers or third parties. Thisgame.com does not guarantee accuracy and is not liable for offensive or objectionable content.

7. User Content

7.1 You are responsible for your User Content and any resulting harm. Thisgame.com is not liable for its display or misuse, and you indemnify Thisgame.com against related losses.

7.2 Buyer reviews of Sellers or Programs are not guarantees and may be removed at Thisgame.com’s discretion. Thisgame.com is not liable for reliance on reviews.

7.3 Content like blog posts or reviews is for informational purposes only, with no assurance of accuracy.

7.4 Users warrant they have rights to post User Content and comply with third-party licenses.

7.5 Thisgame.com may monitor, edit, or remove User Content deemed inappropriate or harmful.

7.6 You retain ownership of User Content but grant Thisgame.com a worldwide, sublicensable, royalty-free license to use it for business and marketing purposes.

8. Payments

8.1 Buyers must pay the Program Price as specified in the Confirmation Order using valid payment methods (e.g., MasterCard, Visa, PayPal, Bitcoin).

8.2 Online payments may be subject to Seller terms, which Buyers must review. Payment constitutes acceptance of those terms.

8.3 Program Prices are generally non-refundable.

8.4 After payment, Thisgame.com confirms receipt, and the Seller issues an invoice to Thisgame.com, which may be provided to Buyers upon request.

8.5 Thisgame.com may delay or decline purchases and limit quantities.

8.6 Refunds are discretionary, reviewed individually, and unavailable for played games or redeemed keys. Requests must be made within 7 days of key delivery.

8.7 Refunds for Crypto purchases over 90 days or other methods over 120 days may be issued as gift cards or store credit, subject to terms.

8.8 Buyers confirm they are of appropriate age for the Program and authorized to use the payment method. Contact support@thisgame.com for issues.

9. Pre-Orders

9.1 Pre-ordered Programs are paid at the time of order but delivered on the specified date.

9.2 Thisgame.com strives to deliver pre-order Game Keys before the official release but does not guarantee timely delivery and is not liable for delays.

9.3 Pre-order prices may vary, and sales may be revoked with a refund from the Seller.

9.4 Refunds for pre-orders follow the same time limits as standard purchases (see 8.7).

9.5 Pre-order bonus content is included where possible but not guaranteed. Check your orders page regularly for updates.

10. Third-Party Content

10.1 Thisgame.com may link to third-party platforms or content, which are outside our control. Access is at your own risk, and our Terms and Conditions do not apply.

10.2 This Agreement does not permit distributing or altering Third-Party Content.

11. Intellectual Property

11.1 Thisgame.com owns all intellectual property related to the Online Store and Services. Third-party trademarks remain with their owners. No rights are transferred to you.

11.2 Thisgame.com, www.thisgame.com, and related trademarks are registered and may not be used without permission.

11.3 Notify us of copyright violations. Repeat infringers will lose access to the Online Store.

12. Email Communications

12.1 You consent to receiving electronic communications about Services or Program updates. Opt out via the Contact Us section.

12.2 Electronic communications satisfy legal requirements for written notices. Notify Thisgame.com per clause 16.5.

13. Termination

13.1 To terminate, stop using Thisgame.com. To delete Account data, contact support@thisgame.com. We retain data as needed for legal obligations.

13.2 Non-compliance may result in termination without notice or refund.

13.3 Provisions like ownership, disclaimers, and liability limits survive termination.

14. Disclaimer of Warranties

14.1 Thisgame.com does not guarantee the accuracy, reliability, availability, or security of Services, Seller Services, or Programs. You assume all risks.

14.2 You are responsible for interactions with other Users or third parties. Thisgame.com does not screen Sellers or verify their statements.

14.3 Thisgame.com disclaims all warranties regarding Sellers, Programs, or Services, including quality, safety, or legality.

15. Release and Indemnification

15.1 You indemnify Thisgame.com against claims, losses, or damages from your use of the Online Store, Services, or Programs, or from User Content violations.

15.2 You release Thisgame.com from claims arising from disputes with other Users.

15.3 Thisgame.com and Sellers may pursue legal action against Buyers for losses caused by their actions.

15.4 Thisgame.com is not liable for damages from service interruptions, Program quality, inaccuracies, unauthorized access, or disputes.

16. Miscellaneous

16.1 Governing Law: This Agreement is governed by the laws of Jersey. Any disputes between a User and Thisgame.com regarding this Agreement shall be settled amicably, failing which the courts of Jersey shall have jurisdiction.

16.2 Severability: Invalid provisions will be construed to reflect original intent, with remaining terms in effect. Non-enforcement is not a waiver.

16.3 Assignability: Thisgame.com may assign rights without consent. You may not assign rights without our written consent.

16.4 Notices to Users: Communications will be sent to the email provided in your Account, deemed served upon sending.

16.5 Notices to Thisgame.com: Send communications to info@thisgame.com, deemed received upon electronic receipt.

16.6 Gender Neutral: Singular/plural and gender terms are inclusive as required by context. “Hereof,” “herein,” and “hereafter” refer to the entire Agreement.
